Ensemble Performing Arts Canada ULC, an Alberta unlimited liability corporation, and Acrobatic Arts LLC, a Delaware limited liability company (collectively “Acrobatic Arts,” “Company” or “we,” “our” or “us”) understand that privacy is important to you and want you to know that we are committed to safeguarding your Personal Information (defined below). As a result, we want to provide you with a clear picture of how the Personal Information that you provide to us is processed, managed, and protected by us, and what your choices are with respect to that information.
This Privacy Policy is global in nature and governs the Company’s websites (including www.acrobaticarts.com, all subdomains, and all portals) (the “Website”), applications and other items that post a link to this Privacy Policy and applies to personally identifiable information from or about an individual (“Personal Information”) that we may collect from you.
Acrobatic Arts provides access to its curriculum through apps for IOS and Android. Acrobatic Arts uses in-house apps to evaluate students participating in exams live online via Zoom and in person. Teacher training and certification is taught live online via Zoom. Physical merchandise and instructional videos can be purchased through our Website. Acrobatic Arts also provides live trainings, teacher certifications, student examinations and sale of merchandise in person apart from its Website. The Website, the apps and the teaching and sales offerings may be referred to collectively as “Services.”
We offer our Services to dance studios, dance teachers and dance students (and their families).
If you voluntarily provide your information in the course of interacting with our Website or otherwise using our Services, we will take that as your agreement to our collection, use, and disclosure of your information as set forth in this Privacy Policy.
This Privacy Policy does not apply to any products, services, websites, or content that are offered by third parties (“Third Party Services”), which are governed by their respective privacy policies.

Acrobatic Arts also receives information from lists received through trade shows and conferences that it attends. For example, a trade show may produce a list of attendees, and Acrobatic Arts will use the list to communicate with the attendees. We may combine the information we collect from third parties with information that we have collected from you or through your use of the Services.

We may obtain information about your location to provide customized Services, content, and other information that may be of interest to you. If you no longer wish for us or our service providers to collect and use location information, you may disable the location features on your Device. Please note that if you disable such features, your ability to access certain features, Services, content or products may be limited or disabled.

Using the other pieces of personal information collected about you, we may draw inferences about you, reflecting what we believe to be your preferences, characteristics, predispositions, and attitudes.

From time to time, Acrobatic Arts may invite you to participate in an online survey administered by Acrobatic Arts or a third-party agent. In addition to questions about your experience with the Services, these surveys include Personal Information such as name and email, and may request additional profile information. The results of these surveys help us better understand the needs of our customers in order to improve the Services, and may be shared in aggregate format with third parties.
(b) Testimonials
We display personal testimonials of satisfied customers and dance instructors on our Website in addition to other endorsements. With your consent, we may post your testimonial along with your name, company, title, logo, or profile photo.
(c) Referrals
Acrobatic Arts may invite you to participate in a referral program to inform your colleagues and friends about our Services. If you choose to use our referral service to tell a friend about our Services, we will ask you for your friend’s name and email address, which we understand you are authorized to provide.

We may share advertisements from partners including past and current marketing partners. We also provide you with advertisements for Ready Set Acro which is a shared product from a third party, BoomGate.

You agree that any referrals, notices, agreements, disclosures, or other communications that we send to you electronically will satisfy any legal communication requirements, including that those communications be in writing. Where permissible under applicable law, we may use certain information about you, such as your email address, de-identify it, and share it with social media platforms, to generate leads, drive traffic to Acrobatic Arts, or otherwise promote our products and services.

We may share information about you, such as your username, and other information that will help others understand your connections with others using our services. Your account privacy settings may allow you to limit the other users who can see the personal information in your user profile and/or what information in your user profile is visible to others. Please remember that any content you upload to your public user profile, along with any personal information or content that you voluntarily disclose online in a manner other users can view (on discussion boards, in forums, messages and chat areas, etc.) becomes publicly available, and can be collected and used by anyone. Your username may also be displayed to other users if you send messages or comments or upload images or videos through the Services and other users can contact you through messages and comments.

One of our unique features allows you to enable or log in to the Services via various social networking services like Facebook, Instagram, TikTok, YouTube, Google, X or LinkedIn (“Social Networking Service(s)”). By directly integrating these services, we make your online experiences richer and more personalized. To take advantage of this feature, we will ask you to log into or grant us permission via the relevant Social Networking Service. When you add a Social Networking Services account to the Services or log into the Services using your Social Networking Services account, we will collect relevant information necessary to enable the Service to access that Social Networking Service and your data contained within that Social Networking Service. We incorporate commercially reasonable safeguards to help protect and secure your Personal Information. However, no data transmission over the Internet, mobile networks, wireless transmission, or electronic storage of information can be guaranteed 100% secure. As a result, we cannot guarantee or warrant the security of any information you transmit to or from our Website, and you provide us with your information at your own risk.
Under the Shine the Light law, California residents may request certain information regarding Acrobatic Arts’s disclosures in the prior calendar year, if any, of their Personal Data to third parties for their own direct marketing purposes. You must clearly state the nature of your California Privacy Rights request and provide sufficient information for us to process your request; at a minimum your name, email address, and California postal address. At this time, we do not recognize and honor Global Privacy Control (“GPC”) for U.S.- based users; if GPC is enabled, we would recognize this as an “opt out of the sale or sharing of personal information” or as an “opt out of targeted advertising and the sale of personal data” request (non-California U.S. residents).
Do Not Track (“DNT”) is a web browser setting that requests that a web application disable its tracking of an individual user. Because Acrobatic Art works with global companies and technologies, we may transfer your Personal Information outside of the country in which it was originally provided. In addition to the global Privacy Policy, this Addendum sets out how we collect, store, use, disclose and otherwise manage personal information in New Zealand in compliance with the Privacy Act 2020 ("Privacy Act").
Disclosure of personal information outside New Zealand
We may disclose your personal information to foreign entities outside New Zealand. When we do so, we will ensure that the foreign entity is required to protect your personal information in a way that, overall, provides comparable safeguards to those in the Privacy Act, for example, pursuant to a data transfer agreement with the foreign entity.
Access to and correction of your personal information - New Zealand
You are entitled to receive confirmation about whether we hold personal information about you, and to access that personal information. You are also entitled to request that we correct the personal information we hold about you and/or request that we attach a statement of correction to your personal information.
